Dear Dr Whittaker,
Although I have been advised by my legal team not to post on the Democracy Forum (formerly known as the UKIP Forum) I still, however, read it on a regular basis. My attention was drawn to posts by Rob McWhirter using the name ‘Sponplague’. His two posts are included below. Both were posted on 27th August on a thread entitled ‘Another John West Letter’. I note the matter has also been placed in the public domain by Greg Lance-Watkins in his Butterflies and Caterpillars ‘Clean EUkip up NOW & make UKIP electable!’ series.

So:
1. Whatever else, Nigel is on the NEC as party leader.
2. As an elected representative, i.e. MEP, he is not entitled to be an elected member of the NEC, which makes him one of the two elected representatives - John Whittaker is the other of these.
3. This means that the place that Nigel gained in 2006 is, or should be vacant.
All clear?

It now appears that I was elected to the NEC on the 20th March 2008 as I came fifth with 2,307 votes. Therefore, in accordance with the UKIP Constitution rules 7.6 and 7.7, I am the twelfth elected NEC member. In light of this revelation why have I never been invited to undertake my duties as an elected NEC member?
This failure to inform me of my election to the NEC is clearly another example of the total failure of UKIP’s leadership to act in accordance with our own written constitution. I look forward to hearing the reason for your failure, both to adhere to the UKIP Constitution and to formally invite me to take my elected place on the NEC. I also look forward to receiving details of the next NEC meeting as I fully intend to take my seat on September 8th in order to fight for openness, accountability and democracy within our Party.
I also understand from material in open circulation that Lisa Duffy may be ineligible to sit on the NEC as she gained election dishonestly by misleading the voters as she failed to state that she is the cohabite of a staff member thus technically precluded as being one and the same as a member of staff and clearly precluded as having failed to inform members of this vital fact.
I have sent a copy of this email to all members of the NEC and other members of the leadership of UKIP because as to date you have failed to acquit your duty in responding to my email correspondence. I also note that the Party Secretary likewise seems to have little understanding of his responsibilities under law.
